1. Provider

These Terms of Service ("Terms") govern your use of TradeStats ("Service"), operated by Graf Consulting GmbH, Keplerstrasse 105/4, 8020 Graz, Austria ("we", "us", "Company"). By accessing or using the Service, you agree to these Terms.

2. Description of Service

TradeStats is a web-based trading journal and analytics platform that helps traders track, analyze, and improve their trading performance. The Service provides tools for trade logging, performance analytics, strategy management, and data import from various trading platforms and brokers.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to use the Service.

4. Subscription and Payments

The Service offers paid subscription plans billed on a monthly or annual basis through our payment processor, Paddle (Paddle.com Market Limited). New accounts start with a 14-day free trial. By subscribing, you authorize recurring charges at the applicable rate.

Prices are displayed inclusive of applicable taxes. Paddle acts as the Merchant of Record for all transactions and handles billing, tax collection, and payment processing on our behalf.

5. Free Trial

New accounts receive a 14-day free trial with full access to all features. If you do not subscribe before the trial ends, access to paid features will be restricted until you choose a subscription plan.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code
  • Resell or redistribute the Service without our written consent

7. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Graf Consulting GmbH and protected by copyright and other intellectual property laws. Your trading data remains your property. We do not claim ownership of any data you upload or create within the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Austrian data protection law.

9. Disclaimer

TradeStats is a journaling and analytics tool. It does not provide financial advice, trading signals, or investment recommendations. Past performance data displayed in the Service does not guarantee future results. You are solely responsible for your trading decisions.

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or accuracy of analytics data.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Graf Consulting GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of your use of the Service.

11. Termination

You may cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data before account deletion.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Austria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Graz, Austria. For consumers within the EU, mandatory consumer protection provisions of your country of residence apply.
